Welcome to Ref Marty (“Ref Marty,” “the App,” “we,” “our,” or “us”), a product of Jamcono. These Terms of Service (“Terms”) govern your access to and use of the Ref Marty mobile application, website, and any related services (collectively, the “Services”).

By downloading, installing, accessing, or using Ref Marty, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Services.

1. About Ref Marty

Ref Marty is a visual communication tool designed to help parents, guardians, caregivers, educators, and other responsible adults communicate expectations through a simple system of visual cards and optional countdown timers.

Ref Marty is intended to assist communication and consistency within families and supervised environments. The App is a tool only and is not intended to replace parental judgment, professional advice, or individualized care.

2. Eligibility

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to download, purchase, or use Ref Marty.

Children should only use the App under the supervision of a parent, guardian, teacher, caregiver, or other responsible adult.

3. License to Use

Subject to these Terms, Jamcono grants you a limited, non-exclusive, non-transferable, revocable license to install and use Ref Marty for your personal, non-commercial use.

This license does not transfer ownership of the App or any intellectual property.

You may not:

Copy or redistribute the App except as permitted by applicable law.
Reverse engineer, decompile, disassemble, or attempt to extract the source code.
Modify or create derivative works of the App.
Remove or alter copyright, trademark, or proprietary notices.
Use the App for any unlawful purpose.

4. Acceptable Use

You agree to use Ref Marty responsibly and in accordance with all applicable laws.

You are solely responsible for:

How you choose to use the cards.
The consequences you establish.
Timer durations.
Parenting decisions.
Supervising children while using the App.

Jamcono does not direct, recommend, or require any specific parenting method or disciplinary approach.

5. No Professional Advice

Ref Marty is provided for informational and communication purposes only.

The App does not provide:

Medical advice
Psychological advice
Mental health advice
Behavioral therapy
Educational advice
Legal advice

If you have concerns regarding a child’s health, development, emotional wellbeing, or behavior, consult an appropriately qualified professional.

6. No Guarantee of Results

Every child, family, classroom, and situation is unique.

Jamcono makes no representations or warranties that use of Ref Marty will improve behavior, communication, parenting outcomes, educational performance, or any other specific result.

Results will vary based on individual circumstances.

7. Intellectual Property

All rights, title, and interest in Ref Marty remain the exclusive property of Jamcono.

This includes, but is not limited to:

The Ref Marty name
Marty character
Logos
Artwork
Illustrations
Card designs
Website content
Software
Graphics
Documentation
The Play Book
All related branding and materials

Nothing in these Terms grants you ownership of any intellectual property.

8. Updates and Modifications

Jamcono may release updates, enhancements, bug fixes, security improvements, or new features at any time.

We reserve the right to modify, suspend, or discontinue any portion of the Services without prior notice.

9. Third-Party Services

The Services may include links to or integrations with third-party websites, platforms, or services.

Jamcono is not responsible for the availability, content, security, or privacy practices of third-party services.

Your use of third-party services is governed by their own terms and policies.

10. Disclaimer of Warranties

Ref Marty is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, Jamcono disclaims all warranties, express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy
Reliability
Availability

We do not guarantee that the App will operate without interruption or error.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Jamcono shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to:

Use of the App.
Inability to use the App.
Reliance on information provided through the App or Website.
Any decisions made by users while using the App.
Interruption, delay, or unavailability of the Services.

Your use of Ref Marty is entirely at your own risk.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Jamcono, its owner, affiliates, licensors, contractors, service providers, and successors from and against any claims, liabilities, damages, losses, costs, expenses, or reasonable attorneys’ fees arising from:

Your use of Ref Marty;
Your violation of these Terms;
Your misuse of the App or Website;
Your violation of any applicable law; or
Your violation of the rights of any third party.

13. Termination

Jamcono reserves the right to suspend or terminate your access to Ref Marty or any portion of the Services if these Terms are violated or if continued access could adversely affect the security, operation, or integrity of the Services.

Termination shall not affect any rights or obligations that accrued prior to termination.

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and any other provisions intended to survive shall remain in effect following termination.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

Any legal action arising from these Terms shall be brought in the appropriate state or federal courts located within the State of Florida, unless otherwise required by applicable law.

15. Dispute Resolution

We hope to resolve any concerns quickly and fairly.

Before initiating any formal legal action, you agree to contact Jamcono and make a good-faith effort to resolve the dispute informally.

If a dispute cannot be resolved through informal discussions, the parties agree that, where permitted by applicable law, the dispute shall be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court or for disputes involving intellectual property rights or requests for injunctive relief.

Arbitration shall be conducted in the State of Florida under the rules of the applicable arbitration provider unless otherwise required by law.

Nothing in this section limits either party’s right to seek temporary or permanent injunctive relief to protect intellectual property or other legal rights.

16. Electronic Communications

By using Ref Marty, you agree to receive communications from Jamcono electronically.

We may provide notices, updates, policy changes, legal communications, service announcements, or other information through the App, our website, or by email where appropriate.

You agree that electronic communications satisfy any legal requirement that such communications be in writing.

17. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

18. Changes to These Terms

Jamcono may revise these Terms from time to time.

When changes are made, the updated version will be posted on our website with a revised Effective Date.

Your continued use of Ref Marty after any changes become effective constitutes acceptance of the updated Terms.
